Pressure on Parliament to pass two bills

Women’s groups are mounting pressure on two parliamentary select committees for the speedy passage of the Property Rights of Spouses Bill (PRSB) and the Interstate Succession Bill (ISB) which are both before the House.

The two bills, which were first laid before the house in October 2009, deal with spousal property rights at death and at divorce and both recognise and deal with the contribution made by spouses towards the acquisition of property.

The report on the ISB is presently with the Constitutional, Legal and Parliamentary Affairs and Gender and Child Committees (CLPAC) for a second reading while the PRSB is yet to be reviewed by the CLPAC and the Gender and Child Committees (GCC) jointly.

To this end, the Property Rights of Spouses Coalition, made up of like-minded non-governmental organisations, organised a two-day consultative meeting in Akosombo in the Eastern Region for members of CLPAC and GCC to brief them on the need to ensure the speedy passage of the two bills.

The meeting was sponsored by the United Nations Development Programme (UNDP).

The group also organised a follow-up meeting with male parliamentarians on the PRSB as part of its efforts to sensitise them to the bill.

The Chairperson of the Coalition, Mrs Sheila Minkah-Premo, who briefed the parliamentarians, said issues relating to the property rights of spouses in Ghana had been problematic for a long time as the country had a plural legal system and the laws on marriage were regulated by the customary law, Islamic law and by statute.

She said under each of those regimes, females were usually at the losing end when it came to the sharing of properties acquired at the end of a marriage, irrespective of the type of marriage, be it customary marriages, marriages governed by the Marriage of Mohammedans Ordinance (CAP 129) and marriages under the Marriage Ordinance (CAP 127).

Mrs Minkah-Premo said the coalition’s action had also been necessitated by the fact that many women were married under the Customary and Islamic marriages, which were potentially polygamous, and that had increased their vulnerability in terms of adequate protection of their property rights.

According to her, Article 22 of the 1992 Constitution calls on Parliament to enact legislation to regulate the property rights of spouses. The two bills she said were aimed at achieving this obligation.

She expressed the expectation of the Coalition that the bills would be passed into law by the end of the first quarter of 2012.

The Ranking Member for the GCC, Ms Gifty Ohene-Konadu, in a remark, urged members to remove obstacles that would pave the way for the bills to be passed into law.

She stressed that there should be a way of solving the delay of the passage of the two bills, especially the PRSB, and promised to get additional information on how the coalition could forge ahead to ensure its passage.

At the Akosombo meeting, it was identified that most males in Parliament had problems with the PRSB and Mr Joe Osei Wusu of the CLPSC stated that the problem was with the contents of the bill which needed to be addressed to ensure its passage.

He indicated that there were many people who had other children and partners outside the matrimonial home who also had an interest in their properties. He referred to section 13 of the PRSB on the provisions on the distribution of property which should be re-examined.

He also referred to the interpretation section which regarded housework and child rearing section as a form of contribution.

He was however of the view that those were the responsibilities of wives in marriage, adding that the provisions in section 13 and section 10 on joint properties should be examined and amended.

Mr Osei Wusu also had difficulty with how one could agree with a spouse that property was to be acquired separately.

Another member also raised concerns about the provisions on cohabitation in the PRSB, saying that the provisions are not equitable since cohabitees whose men are married under the Marriage Ordinance cannot benefit under the law but those whose male partners are married under customary law can benefit.

The Majority Leader in Parliament, Mr Cletus Avoka, who said most men, including parliamentarians were apprehensive about the two bills as they view them as being in favour of women, advised that the bill was not intended for a particular group of people but was intended to provide a level playing field and that “lawyers and judges should understand that they should not be influenced by the breakfast they take or the type of relationship they have before dealing with an issue in court.”

He reminded members and the Coalition that he deemed the bill very important because it does affect almost every household in the country and as the leader of Parliament and Chairman of the Business Committee of Parliament he would lend his support to the passage of the bill.

He prayed that when it came before Parliament for discussion, members would make themselves available for the amendment of problematic clauses.

He said there was the need to convince members because of their different backgrounds and orientations, and impressed upon all the members to be proactive while in Parliament for the discussion of the bill.

East Ayawaso MP committed to development of area

Dr Mustafa Ahmed, a Deputy Minister for Water Resources, Works and Housing, on Monday pledged that he would continue to work hard to ensure the development of the East Ayawaso Constituency.

He said the constituency has already witnessed some infrastructure developments in the area of education health, sanitation and sports.

Dr Ahmed, who is also Member of Parliament (MP) for East Ayawaso, made these known in an interview with the Ghana News Agency (GNA) in Accra on Monday.

Touching on education he said some classrooms of the Nima cluster of schools were reconstructed, and a new three-story classroom block with a library and an Information and Communication Technology (ICT) center was being built at the Nima cluster of Schools, and  a Senior Secondary Technical School project was being executed  at Kanda.

Dr Ahmed said he distributed test books and exercise books to schools in the constituency to promote education and, he established an educational endowment fund to support brilliant but needy students, especially girls and that “so far many females at the tertiary level are benefiting from the fund.”

He said he provided computers   to schools, and cited the Mount Zion School at Nima and the Islamic Education Unit at Kanda,  to help students to improve on ICT studies.

Dr Ahmed, said the Mamobi Polyclinic was upgraded to a General Hospital and assisted the hospital with theater equipment, and indicated that a proposal has been submitted for the rehabilitation of the dental clinic at the facility.

He said: “I also supported the Nima Government Clinic maternity with equipment and there are plans to build an Out Patient Department , and to upgrade the clinic to a polyclinic. Water supply to the Mamobi Hospital was inadequate but I intervened by drilling a borehole”.

Dr Ahmed said foot bridges and roads, drains and pavements have been constructed in the constituency to facilitate movement of the people and to avoid flooding and to promote good hygienic.

He said:  “Also I supported the Nima District and Divisional Police Command with equipment and also help in the expansion of their underground septic tank and recently donated two computers to the Command.”

Dr Ahmed appealed to parents to take advantage of Government interventions such as the Capitation Grant and School Feeding Programme and send their children to school.

He appealed to delegates to vote for him in the National Democratic Congress parliamentary primaries in the constituency and cautioned the youth to desist from activities that could breach the peace of the constituency.

Don’t sack AG, PC Appiah Ofori urges Prez Mills

The Member of Parliament for Asikuma/Odobeng/Brakwa P.C Appiah Ofori has urged President Mills not to sack the Attorney General Martin Amidu for his recent statement that sought to impugn that his colleague Minister of state was covering up a corrupt case.

The Attorney General since the beginning of the year has come under attack from press houses that are sympathetic to the ruling government over his inability to prosecute former officials of the erstwhile NPP government and also prosecute persons who are believed to be part of some criminal acts including the Killing of the over Lord of Dagbon among others.

Hon. Martin Amidu in his response to the Press houses via a press release stated that I have faith and believe in my Ministerial oath of office as a Minister of State and my cabinet oath that requires me to “uphold, preserve, protect and defend the constitution of the Republic of the Ghana as by law established…” Consequently, I wish to assure the people of Ghana that I still stand by my promise in spite of the fact that hard core criminals in our society today have made it a habit to hold paid membership cards of major political parties in the republic as an unconstitutional insurance against crime and criminal prosecutions’’.

He added “I wish core members and supporters of the NDC who cherish the principles and ideas upon which the party was founded to know that the attacks against me which started in the Daily Post publications of the 3rd January 2012 were planned by a colleague Minister of State, who perceived that my integrity and professionalism as a lawyer was a threat to the concealment of gargantuan crimes against the people of Ghana in which they might be implicated.’’

Speaking on the issue on Adom FM’s Dwaso Nsem show on Monday Jan, 16th Hon. P.C Appiah Ofori threw his support behind the Attorney General in his fight not to condone corruption adding that the A.G must go a step further and mention the name of his colleague who is concealing that “gargantuan crime’’ against the people of Ghana.

“He must not be sacrificed over his comment on corruption in government which has turned out to be a social canker” he said.

He added tyhat President Mills who prior to assuming power had said he’ll investigate even newspaper allegation made against his officials must walk his talk by causing a full scale investigation into the matter and have the culprit brought to book.

Auditor – General’s action was face saving exercise – Aye-Paye

The Member of Parliament for Ayesuano, Samuel Aye- Paye has accused the government of manipulating the Auditor -General to come out with a statement to clarify the payment of judgment debt to Alfred Woyome, as a measure to save the government from further disgrace that the controversial payment has brought it.

According to him, the action by the Auditor General was an afterthought could best be described as a face saving exercise for the government.

The payment of an earlier reported GHC 58 million judgment debt to Alfred Woyome a supposed financier of the ruling party, has been met with a lot of public outcry and has gained public interest as circumstances leading to the payment of the cost awarded him has become contentious, especially as he has confirmed he did not have any contratract with the government of Ghana as an individual but sued in his name. He sued the government for cost incurred after his contract to construct stadia was cancelled.

The Auditor- General on Thursday said only one payment totaling GH¢17, 094, 493.54 was paid to Mr Alfred Agbesi Woyome in 2010 and not GH¢58,905,974.13.

A statement copied to the Ghana News Agency (GNA) in Accra, explained that in 2010, two payment orders were made towards the settlement of claims for Mr Woyome.  The first payment order for GH¢41,811,480.59 was issued on April 6, but this transaction was reversed on the April 13 and put on hold at the Bank of Ghana (BOG).

The statement said on September 22, another payment order for GH¢17, 094,493.54 was issued and paid to Mr Woyome. “This payment was cleared by BOG and subsequently paid to Mr Woyome,” it said.

The statement noted that correspondence on the reversal of the GH¢41, 811,480.59 was not attached to the original order in the books of the Controller and Accountant General and was therefore, not available to the team of auditors from the Office of the Auditor-General, who conducted the audit of the Public Accounts maintained by the Controller and Accountant General.

However speaking on Peace FM’s Kokrokoo show on Monday, Hon. Sam Aye –Paye who smelled something fishy wondered why Mr Woyome since the issue came into the public domain had never denied received the earlier reported GHC 58 million in any of his interviews in the media.

He said Ghanaians are not going to take the eyes and ears off this issue which involves a whopping amount of money and will hold the government in check to ensure that the tax payers hard earned monies are duly accounted.

Investigate AG’s allegations before dismissal – Mensah-Bonsu

The minority leader of Parliament, Hon. Osei Kyei Mensah-Bonsu has stated that the “explosive statement” by the Attorney General and Minister for Justice is a clear indication that the Mills led NDC government is in a state of serious confusion.

He said the “loaded statement which is pregnant with a lot of connotations is baffling and frightening” adding that President Mills must direct an investigation into the gargantuan allegations made Mr Martin Amidu.

Mr Martin Amidu in a press release on Wednesday described sections of the pro-government press as “a partisan and rented NDC press group who perceive that I am not performing the duties of my office in their partisan political interests. ”

He said a colleague Minister of State, who perceived that his integrity and professionalism as a lawyer was a threat to the concealment of gargantuan crimes against the people of Ghana connived to unleash the gullible section of the NDC press on him [Mr Amidu] by the leakage of official documents from his ministry through the perverse section of a rented NDC press to the public beginning the 3rd of January 2012.

The statement by the Attorney General has been condemned by NDC loyalists with some calling for his dismissal for failing to use internal party structures to address his grievances.

Speaking to Citi News in an interview, the Minority Leader who doubles as the Member of Parliament for Suame stated that the allegations by the Attorney General must be investigated and the perpetrators brought to book.

He added that calls for resignation or dismissal are premature saying the core issues raised by the attorney general should be critically assessed and not overlooked.

“Why won’t anybody begin by going into the issues that he has raised, threats on his life? I think it should begin from there. Is it true that people are threatening his life? ” he asked.

He added that “we should also investigate the conduct of what he calls the rented partisan NDC press who are not cool heads. We should investigate their roles.

“What they are doing is illegal for society. Are they doing anything for Ghana as a nation or they want to tear us apart, this is something that Ghanaians must be interested in”.

I will retain KEEA seat- Dr Joseph Annan

Dr Joseph Annan, the National Democratic Congress (NDC) Member of Parliament for the Komenda-Edina-Eguafo-Abirem (KEEA) over the weekend said he had excellent chances of retaining the seat.

He said although he was not the sole contestant of the seat, he was optimistic of his chances of winning the seat with a significant percentage margin due to the confidence and trust his people have in him.

Dr Annan who said this in an interview with the GNA at Elmina, stressed that winning elections was about numbers and development projects and considering the number of development projects he had executed within the last three years, he was sure of retaining the seat.

He said had successfully achieved most of the targets he set, which include honesty, accountability and probity as well as the judicious use of his share of the District Assembly Common Fund in the execution of development projects.

Dr Annan enumerated a number of development projects in the areas of health, education, infrastructural development and the provision of social amenities which include the institution of an educational endowment fund, expansion of the Elmina Health post Out Patient Department, and the extension of electricity to Kwame Atta community.

He said about 100 people were provided jobs in the non-formal sector and that 1,200 cutlasses have been given to farmers in the area in addition to the provision of cocoa spraying machines  as well as the construction of feeder roads.

The MP said more than 1,400 dual decks have been provided  to schools in the municipality  and that a 12-classroom block has been constructed for the Komenda D/A primary school, with a six classroom block for Elmina D/A primary and another six classroom block for Kissi D/A and computer laboratory for the Eguafo-Abirem SHS.

He said a W/C toilet facility have been provided at the Nana Kwebena Gyan Square in Elmina and the Komenda lorry park has also been rehabilitated  and generator provided for the Agona  health post.

Dr Annan pointed out that his campaign was not about dishing out money to influence people to vote for him but about development projects which would make the constituency a great place to attract more tourists and investors.

He said people who were interested in development, honesty, accountability, probity, unity and self- respect should vote for him and they would not be disappointed.

Veep cautions NDC parliamentary aspirants

The Vice President, John Dramani Mahama, has cautioned aspiring parliamentary aspirants of the National Democratic Congress (NDC) using his name and office to prosecute their campaigns to desist forthwith.

A statement signed by his spokesperson, John Abdulai Jinapor, said the Vice President is unhappy with reports that some aspirants in their meetings with delegates claim that they were either asked by him to contest, or they are his preferred candidate in the constituency while others claim that he is the financier of their campaign.

The statement made it clear that the Vice President is not supporting any candidate in the upcoming parliamentary primaries of the ruling NDC and urged delegates to ignore such claims any time they are made.

He also used the opportunity to wish all aspirants well and urged them to carry out their campaign in a civil and decorous manner in the supreme interest of party unity.

Investigate BNI assault on Journalist – O.B Amoah

The Member of Parliament for Aburi/Nsawam, Osei Bonsu Amoah has called for an immediate enquiry into the case in which a female Photo Journalist was assaulted by the Bureau of National Investigation (BNI) on the premises of an Accra High Court on Thursday.

According to him, it’s important that the full facts of the matter is brought to the public domain for whoever is found to have fallen fowl of the law to be prosecuted.

The journalist was covering the case in which an Accra Human Rights High Court ordered for the release of the Head of the Commercial Crimes Unit of the Police CID, DSP Gifty Mawuenyega Tehoda from the BNI cells in connection with the cocaine-turned-baking soda case.

Gifty Lawson and two other workers from the Daily Guide, Mary Annan and one Michael who attempted to shield her (Lawson) were also allegedly manhandled and physically assaulted, before the security operatives whisked Lawson and Michael away to an unknown location.

According to reports, agents of the BNI allegedly pounced on her by gripping her firmly at the waist and in the ensuing scuffle, torn off parts of her dress exposing her undies before finally whisking her away in a Toyota Corolla car with registration number GE 1584 W

Commenting on the matter on e.tv’s BREAKFAST TV show on Friday, Hon. O.B Amoah condemned the unwarranted attack on the journalist, adding that the BNI in doing its legitimate work in the fourth republic has been found to have infringed upon the human rights of individuals, an act which must be stopped.

He was baffled why and how such an unfortunate act could happen at the premises of the law courts where everyone goes to seek justice.

“The culture of impunity appears to be rife in the activities of the BNI in recent times. people are manhandled even on the compounds of our law courts, the courts are definitely not safe, if everyone must come to the courts armed and pulls out a pistol in the least provocation like the BNI operatives did, then the courts which is a security zone would be full of chaos’’ he said.

O.B Amoah stated that the security agencies must know that maximum security of the country will be ensured only if the security agencies collaborate effective with the citizens, adding that this can be done only when there is a good rapport between the agencies and the public.

PAC to conduct public hearing on 2010 Audit Report

The Public Accounts Committee of Parliament will soon commence public hearing on the content of the audit report of the Public Accounts of Ghana for the year ended 31st December 2010.

A release signed by the Chairman of the committee, Mr Albert Kan- Dapaaah confirmed that the Auditor –General had submitted the report to Parliament through the Speaker of Parliament as demanded by Article 87(6) of the 1992 constitution.

The statement said the report contains a couple of chapters on the total of 86 judgment debts paid in 2012 including that paid to Alfred Agbesi Wayome.

“ It is worthy to note that the 1992 Constitution spells out in Article 187(6)  that parliament shall debate the report of the Auditor- General and indeed Parliament is the only institution that is charged with the responsibility to deal with any matter arising from a report of the Auditor- General’’.

The release added that it was therefore important for the committee to conduct its public hearing and submit its report to Parliament to enable the House to deal with matters arising from the audit report as per Article 187 (6) of the 1992 Constitution.

Activities of prayer camps must be regulated – Rashid Pelpuo

The Deputy Majority Leader, Rashid Pelpuo has called for the formulation of a code of conduct for prayer camps across the country to regulate their activities.

According to him, the prayers camps where people go in search of spiritual solutions to their problems rather turn out to be a place where they rather go through a lot of agony due to the dehumanizing treatment meted out to them.

His call comes following the rescue of a 16- year old Junior High School (JHS) student by officials of the Department of Social Welfare and the Kwesimintsim District Police who had been isolated for four years because she was declared a witch by the prophetess of a spiritual church at Apowa in the Ahanta West District in the Western Region.

She was kept in a reptile-infested wooden structure away from the Nazareth Prayer and Healing Camp to await her turn for Prophetess Mary Wood to exorcise the alleged witchcraft from her.

On hearing of the girl’s predicament, a combine team of officials of the Department of Social Welfare and the police visited the prayer camp yesterday to rescue the girl, in spite of resistance from the church.

Commenting on the issue on Metro TV’s Good Morning Ghana show on Thursday, Hon. Rashid Pelpuo who condemned the cruel act on the girl stated that the need to regulate the activities of the prayer camps has become imperative to stem the tide of such callous acts which largely infringe upon the individual’s human rights.

“ In this modern age where such medieval acts must be done away with, we still have such practices going on in Ghana, and it appears the country has not taken a strong position on these acts, nothing can be dehumanizing than restricting a young girl in a reptile infested wooden structure, we must all sit up as a country and find solutions to this bad deeds’’ he said.

Hon. Rashid Pelpuo who is also the Member of Parliament for Wa Central called for the prosecution of prayer camps operators who fall foul of the law to serve as a deterrent to other operators and save people who visit the camps from suffering trauma and unnecessary scares in the lives .
