Supreme court to rule on Bawku MP’s case

The Supreme Court has fixed May 23, 2012 to rule on a submission of no case in a matter brought against the Member of Parliament for Bawku Central, Mr Adamu Daramani Sakande, over his alleged dual nationality.

The court fixed the date after parties in the matter had filed their written addresses and informed the court they did not have additional issues to file.

Members of the Supreme Court panel are Justices S. K. Date-Bah, Julius Ansah, Sophia Adinyira, Rose C. Owusu, Jones Dotse, Annin Yeboah P. Baffoe-Bonnie, N. S. Gbadegbe and Vida Akoto-Bamfo.

A cattle farmer, Sumaila Biebel, in March, 2009 filed a suit at the High Court challenging the eligibility of the MP on the grounds that the MP held both British and Burkinabe passports, and the High Court in a default judgement on July 15, 2009, ordered the MP to vacate his seat.

Dissatisfied with the High Court’s decision, counsel for the MP appealed against the High Court’s decision resulting in the Court of Appeal in a unanimous decision, declaring that Mr Biebel should have gone by an electoral petition, since the matter bordered on electoral dispute.

Under the law, all matters relating to electoral disputes are to be heard as electoral petitions and those petitions are to be heard 21 days after results have been declared.

Aggrieved by the Court of Appeal’s decision, Mr Biebel went to the Supreme Court which decided to take evidence from him.
He has since testified and been cross-examined by one of the lawyers for the MP, Mr Egbert Faibille.

The defence filed a submission of no case after Mr Biebel had completed his evidence-in-chief.

According to the defence, Mr Biebel had failed to fully comply with the rules of evidence and for that reason there was no evidence before the Supreme Court.

It said the standards for submitting exhibits had not been met by Mr Biebel and, for that reason, the court should strike out Mr Biebel’s case.

At the court’s sitting on March 20, 2012, Mr Biebel informed the court that the Ghana Police Service gave him documents upon which he filed the legal suit against the MP.

According to him, he wrote to the Ghana Police Service requesting to be furnished with documents relating to the case, adding that the service responded and furnished him with the relevant documents.

He, however, conceded that he had neither heard of the Foreign and Commonwealth Office of the United Kingdom nor had he personally written to that office in respect of the MP’s nationality status.

The witness also stated that he had not received any correspondence from the United Kingdom Home Office on the nationality status of the MP.

Mr Biebel is also the complainant in a criminal action against the MP at the Fast Track High Court.

The MP was, on July 31, 2009, arraigned before the court, charged with nine counts relating to his nationality, perjury, forgery of passport, election fraud and deceiving public officers to be elected as an MP but was exonerated on six of those charges on July 8, 2010.

He is currently facing three charges of false declaration of office or voting, perjury and deceiving a public officer.

Gov’t condemns Ken Agyapong’s comment

Government has condemned the inciting and potentially genocidal statements by New Patriotic Party (NPP) embattled Member of Parliament for Assin North Kennedy Agyapong.

Vice President John Mahama while addressing members of the Tertiary Education Institutions Network of the NDC (TEIN) in the Ashanti Region, expressed surprise why a Member of Parliament could make such unguarded statements urging all Ghanaians to condemn the comments in no uncertain terms.

The acerbic tongue MP Kennedy Agyapong was arrested last week following his inciting comments on Oman FM that sought to urge one ethnic group against others and declared war in the process. He was granted bail by the Accra Fast Track High Court in the sum of GH¢200,000 with one surety to be justified on Thursday.

Vice Presidents further stated that the ethnocentric comments made by the Assin North MP “should not be taken lightly …the whole nation must rise up and say what he said was absolutely unacceptable…It is the silence of those who should speak for the truth that makes evil triumph.”

Reacting to President Kufuor’s description of Kennedy Agyapong’s arrest as “using a sledge hammer to kill a fly”, His Excellency Mahama said government will even use a bulldozer to kill the ant whose intention is to foment trouble.

Adjaho, GETFund provide library for Akatsi area

Through the initiative of the First Deputy Speaker of Parliament and Member of Parliament for Avenor Ave, Edward Doe Adjaho, the GETfund has built a GHS760,000 two –storey ultra –modern library at Akatsi, the first of its kind in the region.

In recognition of his efforts in getting the facility built for the area, the Akatsi District Assembly has named it ‘Edward Doe Adjaho Library’.

It has an internet facility, offices and halls for group studies.

Mr Adjaho has provided computers and a quantity of books on different disciplines he sourced from the “Book for Africa”, an international non-governmental organization, to stock the library.

The ceremony was attended by Dr Bernard Kwasi Glover and Emmanuel Adzei – Anang, both members of the Council of State, who took turns to encourage the people to put the facility to good use.

Mr Adjaho commended the traditional authorities for providing the land for the facility, and the GETFund for financing it, and urged the people, especially school children, to use it to add to their knowledge for the development of the country.

He announced that the government had made available GHS 6 construction of a hospital for the area.

The Volta Regional Librarian, Elikem Tamakloe, entreated the people to empower themselves through using the facility to acquire knowledge, and appealed to others to contribute to stock it.

Assin North MP leveled with new charges

The embattled Assin North Member of Parliament, Kennedy Agyapong, has been leveled with new charges few hours after an Accra Human Rights Court granted him bail with two sureties in the sum of GH¢ 200,000 on Thursday.

He faces a new charge of causing fear and panic aside the initial charge of treason.

The New Patriotic Party (NPP) lawmaker has been in police custody since Monday after a move to have him released on bail on Wednesday was unsuccessful.

The judge on Thursday morning ordered for his release on health grounds. The lawmaker is reported to have high blood pressure following his detention.

Hon. Kennedy Agyapong was arrested subsequent to his inflammatory and inciting comments urging Ashantes to attack Ewes and Gas in an interview on his own radio station Oman FM in Accra.

Ken Agyapong: I hate no ethnic group

Embattled Member of Parliament Kennedy Agyapong says he has no hatred for any ethnic group in Ghana and that he stands for truth, justice and equality for all Ghanaians.

He said it will be fool hardy on his part to preach hatred for Ewes as four of his children are from Adidome in the Volta Region.

The firebrand MP was addressing hundreds of party supporters who besieged the New Patriotic Party Head quarters, Thursday, to welcome him, after he was granted bail by an Accra Human Rights Court.

Hon. Kennedy Agyepong has been charged with attempted genocide and treason felony for his comments on his own radio station Oman FM last week to the effect that Ashantes should attack Ewes and Gas in reaction to attacks on NPP supporters especially in Odododiodioo and other parts of the country and declaring war in the process.

He was arrested and detained on Monday when he was invited by the police to be questioned; he was charged with treason on Tuesday and taken to court on Wednesday.

The acerbic tongue MP spent three days in the grips of the law enforcement agencies after his lawyers failed to secure bail for him on Tuesday and finally granted bail on Thursday afternoon to a rousing welcome by party supporters.

Ayawaso East MP tours constituency

Dr Mustapha Ahmed, Deputy Minister of Environment, Science and Technology and Member of Parliament (MP) for Ayawaso East in the Greater Accra Region, on Wednesday toured the constituency to encourage people to register in the ongoing biometric registration exercise.

He also visited some registration centres, including the Iran Islamic Library polling station and Irshada Islamic School polling station, where he registered.

Speaking to people in the area, Dr Ahmed noted that Mamobi was not inhabited by only Muslims but there were also Christians who needed to be abreast with issues in the Constituency, Region and the nation as a whole.

He said he had initiated a scholarship scheme for brilliant but needy students, especially girls, because education was the foundation for the development of every country.

Dr Ahmed said there were plans to establish a fund for widows in the Constituency to help them go into business to take care of their children so as not to depend on family heads.

He urged the people to register to be able to exercise their franchise in the December elections.

Dr Ahmed presented a laptop computer to a student of the Irshada Islamic School for her excellent performance and commitment to her studies.

The MP also paid a courtesy call on Sheikh Mohammed Zakaria Addo, Chairman of the Ahlul Sunna wal Jamah Daawah Committee in the Greater Accra Region.

He said the people appreciated the efforts of Muslim leaders in the Constituency adding, “Without you the Muslim leaders, our youth would have been on the streets committing crimes.”

Sheikh Addo said the role played by the Ayawaso MP was appreciated by both Christian and Islamic leaders, adding “Those who think you are not doing anything to complement our effort, have not been fair to you.”

He said the ideology of the MP was in consonance with the Koran adding, “Muslims in this Constituency are proud of you; wherever we go, you respond to our calls whenever we want you and we thank Allah for that.”

Sheikh Addo appealed to the MP to help them set up marriage counselling centres to stop the unnecessary divorce in the area.

He cautioned Muslim youth who were used by politicians to perpetrate violence before, during and after elections to desist from the act and prayed for peaceful elections.

Nii Armah Ashietey presents Maths sets to BECE candidates

Nii Armah Ashietey, NDC Member of Parliament for Klottey Korle in the Greater Accra Region, has toured three Basic Education Certificate Examination centres and presented 2,000 mathematical sets GHc 5,000 to the candidates.

The centres were Boundary Road for 525 candidates from 11 Junior High Schools(JHS), St Joseph’s Roman Catholic Centre, for 220 candidates from seven schools, Osudoku Centre for 482 candidates from 11 schools.

He explained that the donation was to encourage them to take the examination serious.

Nii Ashietey said this was the time for them to show to their parents, teachers, family and the nation that the resources invested in them were not wasted.

“Your teachers, parents and the nation have made significant investment in your training and it is now time for you to justify the resources invested in you,” he added.

Mrs Evelyn Akofa Yentumi, Supervisor at Osudoku Centre, expressed appreciation to the MP for the support.

Mrs Yentumi assured the MP that the candidates would continue to maintain good conduct shown since the examination begun.

Mr Fred Atobrah, Supervisor at Boundary Road Centre, thanked the MP for the support and love shown to the candidates.

At St Joseph’s Roman Catholic Centre, Mrs Eugenia Smart-Abbey, the Supervisor, expressed appreciation for the items.

Adu-Asare chides NPP over silence on vandelism by supporters

The Member of Parliament for Adenta, Kojo Adu-Asare has slammed the leadership of the New Patriotic Party (NPP) for their deafening silence on the destruction of public property by NPP supporters during the arrest of NPP MP for Assin North Kennedy Agyapong.

According to him, this dastardly act must be condemned by all Ghanaians including the NPP leadership as it is criminal and reprehensible.

Some supporters of the New Patriotic Party on Monday night went on a vandalism spree destroying public property including streets lights and traffic lights near the Ghana Broadcasting Corporation, while others broke windscreens of cars parked on the premises of the Police Headquarters and also burnt worn out car tyres on the ring road obstructing free flow of traffic in the process.

It all begun when the incensed crowed were sprayed with water cannon, tear gas and pepper by the police when the milling crowed attempted to go beyond the restricted area at the police headquarters ,when they tried to secure the release of the acerbic tongue MP who had been arrested by the police in connection with his inciting remarks urging Ashantes to attack Ewes and Gas following attacks on some Akans at Odododiodioo In Accra during the on-going biometric registration exercise.

However speaking on Metro TV’s Good Morning Ghana show, the MP for Adenta Hon. Adu-Asare stated that the NPP’s inability to publicly condemn the unruly behavior of the supporters several days after the incident occurred shows the party’s approval and complicity in the unfortunate action.

He said damage to public property is a criminal act and must be discouraged as huge sum of monies are spent putting such facilities in place.

Hon. Adu- Asare wondered why the NPP always has a difficulty in coming out publicly to condemn any misdeeds of the party members describing that behavior as unfortunate.

Binduri MP donates to local BECE candiadates

Mr Stephen Yakubu, Member of Parliament (MP) for Binduri near Bawku in the Upper East Region has donated 495 mathematical sets to 759 local Basic Education Certificate Examination (BECE) candidates as well as 52 footballs and kit to 18 local schools.

Donating the items, Mr. Yakubu noted that education was a priority on his development agenda and that he has put in stringent measures to promote quality education in the area.

He would secure more funds to sponsor students in the area for further studies as well as construct educational infrastructure in communities that did not have such facilities.

Mr. Yakubu mentioned that the constituency had established the brilliant but needy child educational fund and said it would assist children who have qualifies for further studies but could not afford to pay admission and other fees.

The MP disclosed that he was collaborating with the college of education to post teacher trainees to the area to assist in the delivery of quality education to communities in the constituency.

He noted that education was the bed rock for national development and that there was the need to invest in it for the development of the area.

Mr Yakubu urged parents to see education as a tool that could change their lives and the community for the better and devote much time for the supervision and monitoring of their wards education because they were the future of the community.

The MP called on development partners and Parent Teacher Associations (PTA) of the various schools to contribute their quota towards achieving better educational standards for the area.

Mr Leonidas Dakura, Bawku Municipal Director of Education, in-charge of monitoring and supervision, called on the beneficiaries to take proper care of the items and use them for their intended purposes

He commended the MP for his interest in the development of the children and called on all to emulate the gesture since education was a tool for development.

Ex Prez. Kufour cautions gov’t on Kennedy Agyepong’s case

Former President John Agyekum Kufuor has jumped into the controversial treason charges against the firebrand New Patriotic Party (NPP) Member of Parliament (MP) for Assin North, Kennedy Agyapong, calling on the Mills government to be circumspect in the manner in which it handles the case to douse the rising tension in the country following the arrest of the MP.

He urged President Mills to be vigilant in order to protect the peace of Ghana, especially in the run-up to the crucial election in December.

Hon. Kennedy Agyepong has been charged with treason, treason felony and genocide for allegedly inciting Ashantis against Gas and Ewes and declaring war on radio last week following the violence that has characterized the ongoing biometric registration exercise.

In a press release issued on Thursday 19th April, former President Kufuor who is currently attending a meeting in Washington DC, USA noted that the treason charge leveled against the Kennedy Agyapong is like “using a sledge hammer to kill a fly.

“Treason is the highest criminal offense of the land and must be used lightly. It is like using a sledge hammer to kill a fly is like pouring oil unto fire.”

The acerbic tongue MP has been in police grips for the past three days after his arrest on Monday 16th April 2012in connection with his unfortunate statements.
